Direct answer
Calling a worker an employee or independent contractor does not settle legal status. There is no single universal test. Record how control, equipment, substitution, financial risk, opportunity for profit, integration, exclusivity, benefits, working time, duration and termination operate in the real relationship, then apply the current rules of the country where the work is performed.
Preparation sequence
- Describe the actual role, business purpose, location, reporting line and duration.
- Record who controls schedule, method, place, supervision, substitution and performance.
- Trace equipment, expenses, insurance, pricing, financial risk and opportunity for profit.
- Compare integration, exclusivity, benefits, leave, policies, access and termination in the contract and daily practice.
- Give the dated evidence and conflicts to a qualified local reviewer before onboarding or changing the relationship.
Decisions to record
Which country's rules need review?
Start with where the person actually performs the work and record the relevant entities, customer locations, travel and remote-work pattern instead of assuming the contract's governing-law clause answers status.
Who controls the work in practice?
Document recruitment, dismissal, supervision, schedule, method, place, substitution and performance decisions with actual examples, not only drafted rights.
Who carries business risk?
Trace tools, premises, expenses, insurance, pricing, invoicing, rework, profit opportunity and risk of loss so the economic relationship is visible.
Does daily practice match the agreement?
Compare exclusivity, integration, benefits, leave, policies, email, systems, title, reporting and termination practice with the written label and preserve every material mismatch.
Evidence to organize
- Role, location and reporting record
- Proposed agreement and amendments
- Invoices, pay, expense and insurance evidence
- Schedule, equipment, systems and policy access
- Working-practice interviews and unresolved conflicts
Example decision record
The agreement calls a Singapore-based designer an independent contractor, but the company fixes daily hours, supplies all equipment, approves leave, gives an employee title and prohibits other clients. The review pack preserves those facts and the invoicing and risk evidence; it does not declare the legal status from either the label or one factor.
Use the result responsibly
