Singapore's Fair Consideration Framework requires employers to consider candidates fairly for job opportunities. An employer submitting an Employment Pass or S Pass application must normally advertise the role on MyCareersFuture for at least 14 consecutive days and fairly consider applicants before applying, unless a current advertising exemption applies. Exempt employers still need fair, merit-based hiring. The practical evidence pack should connect the real role, accurate advertisement, job-related criteria, consistent assessment, selection reasons and work-pass application; interview and offer records should be retained for at least one year.

Treat fair hiring as the main rule, not a posting formality

MOM's Fair Consideration Framework applies to employers' consideration of candidates for job opportunities. All employers in Singapore are expected to follow the Tripartite Guidelines on Fair Employment Practices and avoid selection based on non-job-related characteristics. The MyCareersFuture advertisement is one part of that process; publishing it does not prove that the later shortlist and decision were fair.

Define the genuine business need before drafting the advertisement. Record the role's duties, reporting line, work location, required skills, experience, qualifications and any other criterion that can be connected to the work. Remove preferences that are not needed for the role. If a particular attribute or language capability is genuinely required, state the job-related reason rather than using it as an unexplained filter.

Build an accurate MyCareersFuture advertisement

Before an Employment Pass or S Pass application, the employer must normally advertise the vacancy on MyCareersFuture for at least 14 consecutive days. The advertisement must represent the role accurately. MOM states that the employer in the advertisement must be the employer submitting the work-pass application, the advertised job must match the occupation in the application, and the salary offered must be clear and consistent.

The salary range must be visible, include the salary offered to the intended work-pass candidate and not be so broad that the maximum exceeds twice the minimum. If one advertisement supports several applications, the applications cannot exceed the number of advertised vacancies. Keep a final copy, advertisement ID, open and close dates, vacancy count and approval record rather than relying on a screenshot captured after the details have changed.

Document any advertising exemption without widening it

MOM currently lists practical exemptions from the MyCareersFuture advertising requirement. These include a company with fewer than 10 employees, a vacancy with fixed monthly salary of at least S$22,500, a short-term role of no more than one month and specified local-transferee circumstances. Check the current condition against the real employing company, vacancy, candidate and assignment before relying on it.

An advertising exemption does not remove the expectation of fair consideration. Keep a short record of the exemption relied on, the source checked, the relevant workforce, salary, duration or transfer facts, and the reviewer. Do not apply an exemption from one vacancy to a different role, employing entity or application without rechecking the conditions.

Use the same job-related criteria for every candidate

Create the shortlist and interview method from the approved role criteria. Ask comparable questions about the capabilities needed for the job, use the same scoring logic, and record exceptions. Application forms should collect only information relevant to assessing suitability at that stage. Personal information that is not needed for the role can create avoidable inconsistency and privacy risk.

A structured process does not require a complicated scoring system. A concise record should show the criteria, evidence reviewed, interview participants, decision reason and any conflict or exception. The result must remain open to qualified local applicants; an assumption that no Singaporean can do the job is not a substitute for fair consideration.

Keep a reviewable hiring and work-pass record

MOM says employers should keep interview and job-offer records for at least one year in case a discriminatory-hiring complaint is made. Retain enough evidence to reconstruct the process: the approved role, advertisement, applicants considered, assessment notes, decision, offer and any withdrawal or change. Limit access because the file contains candidate personal information.

Before a work-pass application is submitted, reconcile the advertisement with the final offer and application. The employing entity, occupation, duties, salary, vacancy count and selected candidate should tell one consistent story. Keep the MyCareersFuture advertisement ID and the dated selection record beside the Employment Pass or S Pass evidence rather than treating recruitment and immigration as disconnected files.

Review risk signals before a complaint or application issue

MOM says companies may attract additional scrutiny when their workforce profiles show room for improvement, including poor COMPASS C3 Diversity or C4 Support for Local Employment scores, or when there are complaints of discriminatory hiring. TAFEP also states that employers that do not follow the Tripartite Guidelines can face scrutiny and curtailment of work-pass privileges. A clean advertisement alone will not resolve a weak or inconsistent hiring record.

Run a focused review when a manager requests nationality, age, sex, race, language or another personal filter; when the offered role or salary changes after advertising; when local applicants are rejected through inconsistent criteria; or when the work-pass application no longer matches the recruitment record. Correct the owning process and preserve the evidence. Where a complaint, threatened challenge or work-pass restriction exists, obtain qualified Singapore employment and immigration advice on the actual facts.
